Article 22 of Decree 87 stipulates that the purchaser and the procurement agency shall not generally require the bidder to provide samples, except that the written requirements cannot accurately describe the procurement requirements or subjective judgments on the samples are required to confirm whether the procurement requirements are met. Where bidders are required to provide samples, the standards and requirements for sample preparation shall be clearly specified in the bidding documents, and whether relevant test reports, sample evaluation methods and evaluation criteria shall be submitted with the samples. In addition, if it is necessary to submit a test report with the sample, it should also specify the requirements of the testing organization, the content of the test, and so on.
At the same time, after the completion of the procurement activities, the samples provided by the unsuccessful bidder shall be returned in time or processed without the consent of the successful bidder; the samples provided by the winning bidder shall be kept and sealed in accordance with the provisions of the bidding documents and shall be accepted as performance acceptance.
