Argentina

Promulgating new methods for weighing goods

Argentina’s new regulations have changed the traditional way of determining the weight of port cargo. It also clarifies the role of SENASA in ship inspection and cargo hold inspection.

The Argentine Customs Administration's ordinary resolution No. 4138-E / 2017 came into effect on October 4, stipulating that importers and exporters can now choose the method used to determine the dry bulk weight. However, the customs authorities still have the right to conduct a counter-check on the weight declared using the shore mark.

The National Health Authority of Argentina (SENASA) Resolution 693-E / 2017 came into effect on November 1, 2017, and stipulated that SENASA's surveyors no longer require mandatory inspection certificates. From this date onwards, the owner is free to choose a private surveyor for inspection and issue a certificate of inspection, but SENASA must notify the investigation 24 hours in advance. SENASA's intervention can also be proposed if the individual surveyor is unable to agree on the cargo or cargo hold. This change does not affect the buyer's request for a certificate from the SENASA surveyor or the importing country's request for a formal inspection certificate.

Thailand

Introduced the new customs law BE 2560 (2017)

Following the DHL notice, Thailand introduced the new customs law BE 2560 (2017). The main changes in the existing provisions of the new law are summarized as follows:

Reducing the time of importation of goods at customs: According to Articles 107 and 108, if the goods are kept by DHL Customs for more than 30 days (including 15 days of customs clearance), the imported goods will be considered as “overdue goods”. For overdue goods, Customs officers have the right to:

1) The item is auctioned or destroyed; 2) The importer or carrier shall ship the item out of the country, otherwise the customs officer has the right to destroy the goods, and the importer or carrier must bear the cost of destruction.

In addition, on November 13, 2017, the Thai Customs stipulates that the goods must be packed with gimmicks, which must be displayed in all relevant documents. According to Section 59 of Chapter 3 of the New Thailand Customs Act, the rules for the “Taro” statement are consistent with Article 118, Section 2469 of the Old Thai Customs Regulations. All packages containing the goods should be accompanied by signs and numbers and marked on all documents relating to such goods.

Therefore, please refer to the instructions provided by the Bangkok Shipowners and Agents Association for MOL, please refer to the following guidelines:

The statement must be actual, the same as the mark or label on the package.

If the skull is a picture, please indicate the words "picture" or "trademark".

If the goods do not have a hoe, please indicate the words "no gimmicks".

Failure to comply with the above policies and guidelines may result in a fine not exceeding 5,000 baht in accordance with the Thai Customs Regulations (Chapter 9, Section 211) and the Old Thai Customs Act (be2469, section 119).

Tunisia

Some imported goods must provide export declaration

Since November 1, 2017, the Tunisia Customs Administration of Tunisia has announced that it will import the following goods to Tunisia and must provide export declarations for the goods to complete the customs clearance of Tunisia.

Brazil

Port of Santos is seriously delayed
